			<content:encoded><![CDATA[<p>We all know that in order to achieve success, when confronted with an important task, it&#8217;s critical to gather as much information as possible. Getting educated on which paths to take and which paths to avoid makes a huge difference in the outcome. This overview is intended to help equip you with the knowledge necessary to make your first home buying experience a positive and fruitful one.</p>
<p><strong>The benefits of having a buyer’s agent are:</strong></p>
<ol>
<li> Market knowledge &#8211; A Buyer&#8217;s Agent will understand the market conditions and have INFORMATION NOT AVAILABLE to the general public on all the properties available in the market on an individual basis.  A buyer&#8217;s agent can locate information on unlisted &amp; pocket listed homes currently for sale, expired &amp; withdrawn homes, rental homes, listing time-frames, neighboring sold prices and dates, average sq ft values, and much more.  Market conditions can vary from neighborhood to neighborhood and street to street. A good buyer’s agent will use information based upon the precise market conditions and an individual listing’s circumstances to identify negotiating strengths on the buyer&#8217;s behalf.  Then help the buyer use those strengths to negotiate the best price and terms possible.</li>
<li>Representation &#8211; Sellers have listing agents who represent their interests. Listing agents are contractually bound to represent their seller’s interests and not the buyer’s.  Dealing directly with the seller or their agent exposes your position and reduces your <a href="http://mscoastrealty.com/negotiating-techniques-buying-a-home/">negotiating strength</a>.  Having an intermediary act on your interests and behalf is important when you are dealing with a transaction of extraordinary magnitude.</li>
<li>The commission &#8211;  The commission structure of the majority of listings is set to be split by 2 agents. One for the buyer and one for the seller, each with their own representative agents. Typically, real estate sales commissions are split evenly between the seller&#8217;s and buyer&#8217;s agents.  If you don&#8217;t have representation, the seller&#8217;s agent pockets the entire commission and you have no representation!  In seven years of selling real estate I have never seen a buyer pay extra for having their own representation unless it was a commercial deal. Why not have representation when it will likely cost you nothing, make things easier, and help you expand your options?</li>
<li>Referrals &#8211; A good buyer’s agent has the contacts you need to ensure a smooth and informed transaction. Once you find your buyer’s agent they will be able to guide you to good lenders, inspectors, appraisers and closing attorneys. This will help you avoid complications and misinformation.</li>
<li>Experience &#8211; A qualified buyer’s agent has experience in all aspects of a real estate transaction. They will know how to handle and guide you through unexpected issues. IE: multiple offer situations, repair allowances, closing cost reductions, home inspection revealed defects, wood destroying insect reports, title issues, contract extensions, negotiations, etc.</li>
</ol>
<p>The Accredited Buyer Representative (ABR) designation is a real estate designation that shows buyers that certain real estate agents/brokers have taken the extra time to complete coursework and have the necessary experience working with buyers to most adequately represent their interests. Damion has achieved this designation and is fluent at working through buyer-specific needs in the real estate transaction.</p>
<p>As long as your buyer’s agent has a solid reputation, is a full-time agent, and you are comfortable with them try their lender referrals if you have not already secured a lender. If for any reason you feel uncomfortable with the referred lenders, let your agent know and begin shopping for yourself. Using the referred lenders are a benefit to you because a strong buyer’s agent has developed relationships with lenders that have a proven track record and will be able to more closely work to get the deal closed for you.</p>
<p><strong>Tips for choosing a lender:</strong></p>
<ol>
<li>Meet with them face to face. Don’t be just another voice on the phone. A face to face meeting develops rapport and will help you to receive more personalized service. 9 times out of 10 out-of-state lenders you found on the internet and have never met will give you more headaches than you expected or even worse.</li>
<li>Shop mortgage brokers or originators &#8211; not banks. Mortgage brokers/originators usually can offer you a wider range of options for financing. Most banks have specific guidelines on lending and cannot offer you the flexibility that mortgage brokers can. We have a mortgage originator that has always met or beat any quoted financing from any bank. We use this mortgage originator constantly and he is consistently on top of the financial market conditions and all of our clients’ specific loans. He does it for less than the bank and we have found him twice as reliable.</li>
<li>Ask for a “Good Faith Estimate” (GFE). A “GFE” will break down your estimated closing costs and is required by law to be provided to you by your lender. You can use a “GFE” to compare local lenders and make a decision on which “professional” provides the best service for less. NOTE: Have your buyers agent review each “GFE” to make sure that nothing was left off. If you choose a seemingly cheaper lender who actually just left something off you will usually find that their service is as inept as their “GFE”. For all practical purposes &#8211; you just want to make sure you are comparing apples to apples <img src='http://mscoastrealty.com/wp-includes/images/smilies/icon_smile.gif' alt=':)' class='wp-smiley' /> </li>
</ol>
<p><strong>Other important items to note:</strong></p>
<ol>
<li>If you don’t expect to live in your new home for a long time, IE: military transfer, it is likely to be in your best interests to consult an Investment Realtor. A good Investment Realtor as a buyer’s agent will help you to choose your purchase while developing an ‘exit strategy” which can have a huge impact on your quality of life once it comes time to sell. We have worked with investors for years to &#8217;strategize&#8217; their best return on investment in residential real estate.</li>
<li>Home inspectors are worthwhile. They cost between $250 &amp; $400 but they can save you thousands, even tens of thousands. It is especially critical for first time buyers to hire an inspector and be present for the inspection. This way the buyer will become familiar with the maintenance items and issues with their new house. Think of the inspection as a “class” on your new home. Not every inspector is the same. Make sure they are licensed and reputable. Any full-time agent will have a qualified home inspector they can recommend.</li>
<li>Be prepared to act. Before you begin looking at properties for sale you need to be pre-qualified with a lender. You want to make sure you shop the correct price range! No matter how slow or active the market is you can bet that when a good listing comes up for sale other people will want it as well. If you ever are in a multiple offer situation on your “dream house” and you do not have a pre-qualification letter but the other buyer does, guess who probably gets the house. Don’t miss out! Be prepared.</li>

			<content:encoded><![CDATA[<p>You have been driving around, looking at homes, calling every agent you see a sign for, finally write an offer on a house and you get to the agency disclosure and find out that the agent you have been friendly with for the past week &#8211; the one that knows every intimate detail of your financing, and the one that KNOWS you are willing to pay top-dollar for that new house &#8211; is not your agent!</p>
<p>The above scenario happens a LOT in our industry and while agency laws vary from state to state, the major gist of all of them is that the agent with the listing represents the seller first and foremost. Sure, you may run into a dual agency or implied agency relationship with a Realtor® that you deal with, but it is important to get the details of your representation up front as it could save you thousands of dollars and a lot of headaches.</p>
<p>There are many types of agency relationships but we are going to focus only on the ones that are relevant to Mississippi since that is the target audience for this post. There are Ultimately 4 different ways you can be represented in a real estate transaction in Mississippi, as a Seller&#8217;s Agent, Buyer&#8217;s Agent, in a Dual Agency, or as a Customer.<span id="more-289"></span></p>
<p><strong>Seller&#8217;s Agent:</strong><br />
A seller&#8217;s agent represents the best interest of the seller only and it is his duty to procure the best price and terms for the seller. A seller&#8217;s agent owes the seller, and only the seller, the fiduciary responsibilities of loyalty, confidentiality, obedience, disclosure, full accounting and duty to use skill, care and diligence. To the buyer in a transaction, the seller&#8217;s agent must exercise a duty of honesty and fair dealing as well as disclosure of all known facts to the buyer or buyer&#8217;s agent which materially affect the value of a property which are not known to, or readily observable by the parties in the transaction.</p>
<p><strong>Buyer&#8217;s Agent:</strong><br />
A buyer&#8217;s agent represents the best interest and terms of the buyer only. The duties of a buyer&#8217;s agent are the same fiduciary responsibilities of loyalty, confidentiality, obedience, disclosure, full accounting, and the duty to use skill, care and diligence. The buyer&#8217;s agent still owes the seller a duty of fair dealing.</p>
<p><strong>Dual Agent:</strong><br />
Dual agency relationships must be fully disclosed to all parties in the transaction. While all agency relationships should be fully disclosed, dual agency is kind of like an attorney representing the husband and wife in a divorce case. Each party has differing wants, but the dual agent walks a fine line between the two.<br />
A dual agent should never represent the interest of one party to the extent it would create a detriment to the other.</p>
<p><strong>Customer:</strong><br />
A customer in a real estate transaction basically has no representation and the agent can only ask you what you want in the terms without giving advice. The duties of fair dealing must still be there but ultimately their duties and responsibilities lie elsewhere. A customer is basically &#8220;representing himself&#8221;.</p>
<p><strong>Implied Agency and Agency Disclosure:</strong><br />
Disclosure of agency relationship should be made at the &#8220;first substantive meeting&#8221;, basically meaning as soon as anything relative to pricing, financing, or ability to purchase is discussed. Typically, a working with a real estate broker form is presented the first time you meet. Many agents do not do this out of fear of presenting paperwork to someone the first time they meet. If your agent does not provide this to you &#8211; ASK FOR IT. It is your right to get this form and knowledge of how you will be represented in any potential purchase.</p>
<p>Implied agency is a way of creating an agency relationship without actually meaning to. If a real estate agent asks you personal questions about your financing or ability to purchase, and you give them the information, they may have created an implied agency. There are many other ways of creating an implied agency. A general rule of thumb &#8211; if it quacks like a duck and wlks like a duck &#8211; it must be?&#8230;. Yep, an Agency Relationship!</p>
<p><strong>What all this means to you!!</strong><br />
Some basic scenarios here for each agency relationship.</p>
<p>If you are looking to a buy a house and you contacted the listing agent directly. They most likely will want you to be a customer. At this point, any information you give them may be used against you. If you told them you LOVED the house and are willing to pay top dollar, they will tell the seller that and any offer less than the asking price would be a mute point and very likely to be countered. </p>
<p>If you are looking to buy the same house, but you have someone like <a class="special" href="http://mscoastrealty.com/contact-us/">US</a> representing you, we would make sure that you knew to be careful about saying anything to the seller or seller&#8217;s agent that may hurt your negotiating position. This means that the low offer you originally sent is much more likely of getting accepted. We are great at negotiating contracts and have saved our clients hundreds of thousands of dollars cumulatively. </p>
<p>Closing costs are another aspect that many agents miss in a transaction or intentionally try to push to the buyer. As your buyer&#8217;s agent &#8211; we would attempt to negotiate those closing costs for you saving you as much money at closing as possible so more of your money goes towards the house and not the fees!</p>
<p>Using the same transaction, a dual agent, the agent technically is not supposed to say anything to either party about the other. In a perfect world, a true dual agent is about as good as having the buyer and seller in the same room, letting them hash out the details and then just fill in the contract. This is not a perfect world though and most agents will typically play &#8220;Mr. Nice guy&#8221; on both sides just so he can get the deal done and collect his fee. Now this is not always bad, as the outcome may be the same as putting buyer and seller in the same room, but ultimately, the agent is representing only one person&#8217;s interest in this scenario &#8211; his own.</p>
<p>As a customer in the same transaction:<br />
A buyer customer will pay the highest price for the house with the least favorable terms.<br />
A seller customer will get the least for their house with the least favorable terms.</p>
<p><strong>Our Practices:</strong><br />
Typically, we try to be as fair as possible to all parties in a transaction. We do not like dealing with dual agency situations because we realize that is very difficult for us to our jobs as effectively as possible in this case. We have occasionally created an implied agency relationship and had to do a dual agency. This typically happens when we start working with a buyer and then we get a listing that meets their needs. </p>
<p>Typically we will work as a buyer&#8217;s agent for our buyers and a seller&#8217;s agent for our sellers. We obviously have to be fair and honest in our dealings but we are also VERY proficient at negotiating contracts and getting the best price and terms for our clients. </p>

The most important thing to do when confronted with a new experience is to gather as much information as possible.  This will help to educate you on which paths to take and which paths to avoid.  This overview is intended to help equip you with the knowledge necessary to make your first home buying experience a positive and fruitful one.</p>
<p>The most important decision you need to make prior to searching for a home is finding a buyer&#8217;s agent.  The benefits of having a buyer&#8217;s agent are:</p>

2.  Market knowledge- They will understand the market conditions and have information not available to the general public on all the properties available on the market.  Market conditions can vary from neighborhood to neighborhood.  A good buyer&#8217;s agent will use information based upon the market conditions and an individual listing&#8217;s circumstance to negotiate the best price and terms possible for your purchase.<br />
3.  Referrals-  A good buyer&#8217;s agent has the contacts you need to ensure a smooth and informed transaction.  Once you find your buyer&#8217;s agent they will be able to guide you to good lenders, inspectors, appraisers and closing attorneys.  This will help you avoid complications and misinformation.<br />
4.  Representation-  Sellers have listing agents who represent their interests.  Listing agents are contractually bound to represent their seller&#8217;s interests and not the buyer&#8217;s.  The commission structure of 99% of listings is set to be split by 2 agents.  One for the buyer and one for the seller, each with their own representative agents.  In seven years of selling real estate I have never seen a buyer pay extra for having their own representation unless it was a commercial deal.  That fact alone makes having a buyer&#8217;s agent a &#8220;no-brainer&#8221;.  Why not have representation when it will probably cost you nothing and help you throughout the process?</p>
<p>The second most important step is choosing a lender.  As long as your buyer&#8217;s agent has a solid reputation, is a full-time agent, and you are comfortable with them try their lender referrals if you have not already secured a lender.  If for any reason you feel uncomfortable with the referred lenders, let your agent know and begin shopping for yourself. Using the referred lenders are a benefit to you because a strong buyer&#8217;s agent has developed relationships with lenders that have a proven track record and will be able to more closely work to get the deal closed for you.</p>
<p>Tips for choosing a lender:</p>
<p>1.  Meet with them face to face.  Don&#8217;t be just another voice on the phone.  A face to face meeting develops rapport and will help you to receive more personalized service. 9 times out of 10 out-of-state lenders you found on the internet and have never met will give you more headaches than you expected or even worse.<br />
2.  Shop mortgage brokers or originators &#8211; not banks. Mortgage brokers/originators usually can offer you a wider range of options for financing.  Most banks have specific guidelines on lending and cannot offer you the flexibility that mortgage brokers can.  We have a mortgage originator that has always met or beat any quoted financing from any bank.  We use this mortgage originator constantly and he is consistently on top of the financial market conditions and all of our clients&#8217; specific loans.  He does it for less than the bank and we have found him twice as reliable.<br />
3.  Ask for a &#8220;Good Faith Estimate&#8221; (GFE).   A &#8220;GFE&#8221; will break down your estimated closing costs and is required by law to be provided to you by your lender.  You can use a &#8220;GFE&#8221; to compare local lenders and make a decision on which &#8220;professional&#8221; provides the best service for less.  NOTE:  Have your buyers agent review each &#8220;GFE&#8221; to make sure that nothing was left off.  If you choose a seemingly cheaper lender who actually just left something off you will usually find that their service is as inept as their &#8220;GFE&#8221;. For all practical purposes &#8211; you just want to make sure you are comparing apples to apples <img src='http://mscoastrealty.com/wp-includes/images/smilies/icon_smile.gif' alt=':)' class='wp-smiley' /> </p>
<p>Other important items to note:</p>
<p>1.  If you don&#8217;t expect to live in your new home for a long time, IE: military transfer, it is likely to be in your best interests to consult an Investment Realtor.  A good Investment Realtor as a buyer&#8217;s agent will help you to choose your purchase while developing an &#8216;exit strategy&#8221; which can have a huge impact on your quality of life once it comes time to sell.<br />
2.  Home inspectors are worthwhile.  They cost between $250 &#038; $400 but they can save you thousands, even tens of thousands.  It is especially critical for first time buyers to hire an inspector and be present for the inspection.   This way the buyer will become familiar with the maintenance items and issues with their new house.  Think of the inspection as a &#8220;class&#8221; on your new home.  Not every inspector is the same.  Make sure they are licensed and reputable.  Any full-time agent will have a qualified home inspector they can recommend.<br />
3.  Be prepared to act.  Before you begin looking at properties for sale you need to be pre-qualified with a lender.  You want to make sure you shop the correct price range!  No matter how slow or active the market is you can bet that when a good listing comes up for sale other people will want it as well.  If you ever are in a multiple offer situation on your &#8220;dream house&#8221; and you do not have a pre-qualification letter but the other buyer does, guess who probably gets the house.  Don&#8217;t miss out!  Be prepared.<br />
4.  How do you choose a buyer&#8217;s agent?  The simple answer is interview agents until you find one that you are comfortable with.  Please consider us.
